Welcome to Elegante Dove Design Academy – Eddac (“I”, “we,” “our,” “us”). These Terms and Conditions (“Terms”) explain the rules for using our website and services. By visiting or using our site, you agree to follow these Terms. These terms and conditions applies to you such as students/pupils, their parents, and legal guardians—as well as other visitors and users who engage with the Services (collectively referred to as “you”) . If you do not agree with any part of these terms and conditions, please do not use our website.   

Part 1: Terms and Conditions for Pupils and pupil’s parents and/or guardians  

1. Acceptance of Terms

By using Elegante Dove Design Academy website, you confirm that you have read, understood, and accepted these Terms. We may update or change these Terms at any time, so please review them regularly. 

2. Eligibility

Our website and services are designed for parents and guardians of children aged 1-12. By using our services, you confirm that you are at least 18 years old or have permission from a parent or legal guardian. Children under 13 may only access our services with parental or legal guardian consent, in compliance with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without proper consent. 3. Content Enrollment and Access.

3.1 Enrollment

Upon enrollment in a course or purchase of educational materials, you are granted a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes. This license does not grant you any ownership rights to the content.

2.2 Access

We strive to provide uninterrupted access to our Services; however, we do not guarantee that the Services will always be available or that access will be uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of our Services for business and operational reasons.

4. Services Provided

We offer educational content, including: 

– Online English lessons for children Aged 3 to 14 years old and English Lessons for Adults from beginner to intermediate level. 

– Activities that build leadership, sustainability, and social skills. 

– Books, audiobooks, and other educational materials for sale. 

– Live lessons via Zoom. 

– Monthly student meetups. 

Our content follows the principles of the United Nations Sustainable Development Goal 4 (UNSDG4). However, Elegante Dove Design Academy is not affiliated with UNSDG4. We align with its goals as part of our sustainability efforts. 

5. User Responsibilities

When using our website, you agree to: 

– Provide accurate and complete information when signing up. 

– Supervise your child’s use of our services. 

– Use our content for personal, non-commercial purposes only. 

– Follow all applicable laws and regulations. 

The following actions are not allowed: 

– Sharing your account details with others. 

– Copying, distributing, or changing our content without permission. 

– Using the website for illegal or harmful purposes.

6. Accounts and Security

7. Subscription Fees and Payments

To access our educational content and services, a monthly subscription fee is required. By subscribing, you agree to: 

– Provide accurate payment information. 

– Allow automatic payments unless you cancel. 

– Pay the subscription fee by the 30th of each month before the next month begins. 

– Understand that late payments may result in restricted access. 

We process all payments securely and do not store credit card details. Prices may change without notice.

8. Refunds and Cancellations

9. Disclaimers and Limitation of Liability

9.1 Disclaimers

The Services and all content included are provided on an “as is” and “as available” basis without a warranty of any kind. We disclaim all warranties, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the fullest extent permitted by law, Elegante Dove Design Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; and (c) any conduct or content of any third party on the Services.

Part 2: Terms and Conditions for Tutors

10.1 Tutor Registration and Responsibilities

To teach on Elegante Dove Design Academy Tutors must: 

– Provide accurate and complete registration details. 

– Follow all legal and educational guidelines. 

– Maintain professionalism and respect with students and parents. 

– Create content that aligns with our educational objectives.

10.2 Payment and Commission Structure

Tutors are paid based on a revenue-sharing model set by Elegante Dove Design Academy. By registering, tutors agree to: 

– Accept the payment terms outlined in their contract. 

– Submit invoices on time (if required). 

– Understand that failure to meet obligations may result in withheld payments or account suspension. 

11. Content Ownership and Use

Tutors retain ownership of the content they create and upload. However, by using Eddac, tutors grant us a non-exclusive, royalty-free license to use and share their content as part of our educational services.

12. Tutor Conduct and Compliance

Tutors must: 

– Deliver high-quality lessons. 

– Honor their schedules. 

– Maintain a professional and respectful environment. 

– Follow all platform policies and guidelines. 

Violations may result in suspension or termination. 

13. Termination of Services

Eddac can terminate tutor accounts if they: 

– Engage in inappropriate behavior. 

– Do not meet performance standards. 

– Violate our policies. 

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws the jurisdiction in which the Eddac is located, Sweden, without regard to its conflict of law principles.

14.2 Arbitration

Any disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the jurisdiction of the Business primary location. The arbitration shall take place in Sweden and the judgment on the arbitration award may be entered into any court having jurisdiction thereof.

14. Dispute Resolution

Any disputes related to tutoring will be resolved through arbitration in the Jurisdiction in which the business operates following the rules of the jurisdiction. 

15. Miscellaneous

15.1 Modifications

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of the Services after the posting of the revised Terms constitutes your acceptance of the changes.

15.2 Entire Agreement

These Terms constitute the entire agreement between you and Elegante Dove Design Academy regarding the use of the Services and supersede all prior agreements between you and Elegante Dove Design Academy.

15.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.4 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Elegante Dove Design Acadeny failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
